Welcome to FamiDear.
These Terms of Service ("Terms") govern your access to and use of the FamiDear website, online store, products, services, content, features, and related services (collectively, the "Services").
The Services are operated by LUCK IDEA LIMITED, doing business as FamiDear ("FamiDear," "we," "us," or "our").
FamiDear is powered by Shopify, which provides the technology that enables us to operate our online store and provide the Services. Any purchase you make through the Services is a transaction directly between you and FamiDear.
By accessing, browsing, purchasing from, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies or terms referenced in these Terms.
If you do not agree to these Terms or our Privacy Policy, please do not access or use the Services.
Please read these Terms carefully. They contain important information regarding your rights and obligations, including provisions relating to orders, payments, shipping, returns, intellectual property, disclaimers, limitations of liability, and dispute resolution.
Access and Account
By using the Services, you represent that you are at least the age of majority in the jurisdiction in which you reside, or that you are using the Services with the consent and supervision of a parent or legal guardian as permitted by applicable law.
When using certain features of the Services, including creating an account or placing an order, you may be required to provide information such as your name, email address, billing information, payment information, shipping address, and other relevant information.
You agree that all information you provide to FamiDear is accurate, current, and complete, and that you have the right to provide such information.
You are responsible for maintaining the confidentiality of your account credentials and for all activity associated with your account.
You may not sell, transfer, assign, or otherwise provide your account to another person without our prior written consent.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
Products and Product Information
We make reasonable efforts to ensure that product descriptions, dimensions, materials, colors, images, and other product information presented on the Services are accurate.
However, actual product appearance may vary slightly from images displayed on your device due to differences in screens, lighting, photography, natural materials, finishes, and other factors.
For products made with natural materials such as wood, leather, stone, marble, or other natural or handcrafted materials, variations in grain, texture, tone, pattern, and finish may occur and may not constitute a defect.
Product specifications, descriptions, availability, pricing, images, and other information may be changed or updated at any time without prior notice.
We reserve the right to discontinue products or limit product quantities at our discretion.
Where a product page identifies a specific delivery or production timeline, including a 60–90 day Pre-Order timeline, that product-specific information forms part of the applicable order terms.
Orders and Order Acceptance
When you place an order through the Services, you are submitting an offer to purchase the products in your order.
Receipt of an order confirmation does not necessarily mean that FamiDear has accepted the order.
An order becomes accepted when FamiDear confirms acceptance and successfully processes the applicable payment, subject to these Terms and any applicable policies.
We reserve the right to accept, decline, limit, or cancel an order for reasonable business, inventory, payment, pricing, product availability, fraud-prevention, legal, or other legitimate reasons.
If we cancel or modify an order after it has been placed, we will make reasonable efforts to notify you using the contact information provided with the order.
You are responsible for reviewing your order information before submitting the order, including product selection, quantity, dimensions, finish, shipping address, billing information, and other applicable details.
Cancellation and return requests are governed by our Refund, Cancellation & Return Policy.
Prices, Promotions, and Billing
Product prices, discounts, promotions, and other offers may change from time to time.
Unless otherwise stated, the price applicable to your purchase is the price displayed at the time you place your order and confirmed in your order confirmation.
Promotional offers may be subject to additional terms and conditions. If a specific promotional term conflicts with these Terms, the specific promotional terms will apply to that promotion.
You agree to provide accurate and complete billing, payment, account, and contact information.
You represent that you are authorized to use the payment method provided for your purchase.
FamiDear reserves the right to correct pricing, promotional, or billing errors and, where appropriate, cancel or adjust affected orders.
Any taxes applicable to your purchase will be handled in accordance with applicable law and the information presented during checkout.
Shipping and Delivery
FamiDear currently offers free standard shipping for eligible orders within the contiguous United States, subject to the terms and exclusions described in our Shipping & Delivery Policy.
Shipping methods may include UPS, FedEx, LTL freight, or other qualified logistics providers depending on the product, destination, size, and delivery requirements.
Delivery time depends on the individual product.
Standard Products
Products that do not display a Pre-Order or extended production timeline generally follow our standard fulfillment process.
Once a standard product has shipped, applicable carrier tracking information will be provided.
Pre-Order Products
Some products are identified as Pre-Order on their individual product pages and may display an estimated production and delivery period of 60–90 days.
The applicable timeline begins based on the order confirmation and production process described on the relevant product page and applicable Shipping & Delivery Policy.
The product page is the primary reference for the estimated delivery period applicable to that product.
Order Status
For eligible Pre-Order products with a 60–90 day timeline, FamiDear may provide order-status information that is updated according to production and fulfillment milestones.
Once the order enters the shipping stage, applicable carrier tracking information will be provided.
Delivery Delays
Estimated delivery periods may be affected by circumstances beyond FamiDear's reasonable control.
Any applicable delivery-delay compensation is governed exclusively by our Shipping & Delivery Policy.
Shipping Coverage
FamiDear currently ships within the contiguous United States, including the 48 adjoining states and Washington, D.C.
We currently do not ship to:

Customers are responsible for providing an accurate and complete residential or commercial street address and appropriate contact information.

Cancellations, Returns, and Refunds
FamiDear's cancellation, return, and refund rules are governed by our Refund, Cancellation & Return Policy, which forms part of these Terms.
Different rules may apply depending on:

Whether the product is a Standard Product or Pre-Order Product;

Whether the product has been opened, assembled, installed, or used;

How much time has passed since delivery or order confirmation, as applicable;

Whether the issue was caused by FamiDear or by the customer; and
-
Whether the product is eligible for return under the applicable policy.
Customers must follow FamiDear's return authorization and shipping procedures before sending a product back.
Where customer-paid return shipping applies, the customer is responsible for following the return instructions and providing valid tracking information.
Any reimbursement, refund, deduction, restocking charge, or return-shipping reimbursement will be handled according to the Refund, Cancellation & Return Policy.
Nothing in these Terms is intended to exclude or restrict any non-waivable rights or remedies available to consumers under applicable law.
Product Issues, Damage, and Defects
If a product arrives damaged, defective, incorrect, or materially different from the product ordered, please contact FamiDear within the applicable period specified in our Refund, Cancellation & Return Policy.
To assist with the review, we may request photographs, videos, packaging information, order information, product details, and other reasonable documentation.
Depending on the circumstances, FamiDear may provide an appropriate resolution, which may include replacement parts, repair assistance, replacement, refund, partial compensation, or another reasonable solution.
The applicable resolution will depend on the nature and extent of the issue and the applicable policy.
Intellectual Property
All content and materials made available through the Services, including but not limited to:

Product photographs and videos;

Graphics and designs;

Written content;

Website layouts and visual elements;

Product reviews and other user-generated content where applicable; and

are owned by FamiDear, its affiliates, licensors, or other applicable rights holders and are protected by applicable intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial purposes.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, sell, license, or commercially exploit our content without our prior written permission.
FamiDear's name, logos, product names, designs, and slogans may constitute trademarks of FamiDear or its licensors.
All rights not expressly granted under these Terms are reserved.
User Feedback and Reviews
If you submit reviews, comments, photographs, videos, suggestions, ideas, testimonials, or other content to FamiDear ("Feedback"), you represent that you have the right to submit that content.
You grant FamiDear a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use such Feedback in connection with operating, improving, marketing, and promoting the Services, subject to applicable law.
You remain responsible for the content you submit.
Feedback must not:

Violate the rights of another person;

Contain unlawful, defamatory, threatening, abusive, obscene, or fraudulent content;

Contain malware or malicious code;

Misrepresent your identity or affiliation; or

FamiDear may remove or decline to publish Feedback that we reasonably determine violates these Terms or applicable law.
Third-Party Services and Links
The Services may contain links to, integrations with, or functionality provided by third parties.
Third-party services may include payment providers, shipping providers, analytics services, advertising platforms, social media services, financing providers, and other technology providers.
FamiDear does not control third-party services and is not responsible for their independent policies, content, security, availability, or practices.
Your use of third-party services may be subject to the third party's own terms and privacy policies.
Shopify
FamiDear's online store is powered by Shopify.
Shopify provides the technology and infrastructure that enable FamiDear to operate the Services. However, purchases made through the FamiDear store are transactions directly between you and FamiDear.
Shopify is not the seller or merchant of record for products purchased from FamiDear and is not responsible for the products, fulfillment, shipping, returns, refunds, customer service, or other obligations arising from transactions between you and FamiDear.
Your use of the Services may also be subject to applicable Shopify policies and technologies.

This section is intended to clarify the relationship between FamiDear, Shopify, and customers and does not limit any rights that cannot legally be excluded.

You may not use the Services to:

Information on the Services may occasionally contain typographical errors, inaccuracies, omissions, or outdated information relating to products, descriptions, pricing, promotions, availability, shipping, delivery times, or other matters.
FamiDear reserves the right to correct errors, update information, modify product information, or cancel affected orders where permitted by applicable law.
If an order is affected by a material pricing or product-information error, we may contact you and provide available options, including cancellation where appropriate.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
FamiDear does not guarantee that the Services will always be uninterrupted, secure, timely, accurate, or error-free.
To the fullest extent permitted by applicable law, FamiDear disclaims warranties and conditions not expressly provided in these Terms or in applicable written product policies.
Nothing in these Terms is intended to exclude, limit, or waive any warranty, consumer protection right, or other right that cannot legally be excluded or waived under applicable law.
Limitation of Liability
To the fullest extent permitted by applicable law, FamiDear and its affiliates, officers, directors, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, savings, business opportunities, or data arising from or relating to your use of the Services or products purchased through the Services.
To the fullest extent permitted by applicable law, FamiDear's liability arising from a particular order or transaction will not exceed the amount actually paid to FamiDear for the product or products giving rise to the claim, except where such limitation is prohibited by applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability that applicable law prohibits us from excluding or limiting.
Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless FamiDear, LUCK IDEA LIMITED, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising from:

Your violation of applicable law or the rights of another person; or

Your misuse of the Services.
This obligation does not apply to the extent that a claim results from FamiDear's own unlawful conduct or liability that cannot legally be transferred to you.
Suspension and Termination
We may suspend or terminate your access to the Services where reasonably necessary, including where you materially violate these Terms, engage in fraudulent or unlawful conduct, or create a security or operational risk.
Termination does not affect rights or obligations that accrued before termination.
Provisions that by their nature should survive termination, including provisions relating to intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution, will survive termination.
Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law, and the remaining provisions will remain in effect.
No Waiver; Entire Agreement
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
These Terms, together with the policies expressly incorporated into them, constitute the agreement between you and FamiDear regarding your use of the Services and supersede prior communications or agreements concerning the same subject matter.

These Terms and any dispute arising out of or relating to the Services or products purchased from FamiDear will be governed by the laws of Hong Kong, without regard to conflict-of-law principles, except to the extent that applicable mandatory consumer-protection laws require otherwise.
To the extent permitted by applicable law, the courts of Hong Kong will have jurisdiction over disputes arising from or relating to these Terms or the Services.
Nothing in this section is intended to deprive consumers of mandatory rights or remedies available under the laws of the jurisdiction in which they reside.
Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other operational needs.
The updated version will be posted on this page with the revised "Last Updated" date.
Where required by applicable law, we will provide additional notice of material changes.
Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
